Kern Tutoring Terms of Service

Thank you for choosing Kern Tutoring ("Kern Tutoring," "we," "our"). We provide one-on-one and online tutoring services to students in Bakersfield, Kern County, and beyond. These Terms of Service (“Terms”) govern your access to and use of our website, forms, payment portal, and tutoring services (collectively, the “Services”). By accessing or using our Services, you agree to these Terms.


1. Eligibility

  • You must be at least 18 years old to create an account and purchase tutoring services.
  • Parents/guardians contract on behalf of minor students.

2. Services Provided

We offer:

  • In-person tutoring at our Bakersfield location or approved locations.
  • Online tutoring via Zoom.
  • Subject coverage: Elementary (PK–5), Middle School (6–8), High School (9–12), College, and K–12 Test Prep.

3. Plans and Billing

  • Plans: 10-hour (1 month), 24-hour (3 months), 30-hour (4 months).
  • One-time plans are paid in full at enrollment and do not include recurring charges.
  • Monthly plans are billed each month using the payment method provided at checkout.
  • By enrolling in a monthly plan, you agree to complete all scheduled monthly payments for the full duration of that plan’s term.
  • Monthly billing ends automatically once the final installment has been processed.
  • Payments are processed securely by a third-party provider; we do not store full card details.
  • Price changes will be communicated in advance and apply to the next billing cycle.

4. Scheduling, Cancellations, and Attendance

  • Sessions are scheduled by mutual agreement.
  • Cancellation policy: Clients must cancel at least 5 hours before the scheduled session. Failure to cancel within this time will result in the session being billed and/or deducted from the student’s total allocated hours.
  • Late policy: Sessions begin at the scheduled time. If a student arrives late, the session will still end at the originally scheduled time and the entire scheduled session time will count.
  • Unused hours expire at the end of your plan term.

5. Refunds and Pauses

  • Due to the nature of our services, all sales are final and there are no refunds.
  • In exceptional cases (e.g., extended illness, emergencies), you may request a one-time pause of up to 30 days per plan.

6. Parent/Guardian Responsibilities

  • Provide accurate information during enrollment.
  • Ensure the student is prepared with materials and a quiet workspace.
  • For online sessions: maintain a reliable internet connection and supervise younger students.

7. Tutor Conduct and Safety

  • All tutors follow Kern Tutoring’s code of conduct.
  • We may reassign tutors to ensure a good match.
  • Contact us immediately with any safety or conduct concerns.

8. Academic Expectations

  • We aim to improve skills, confidence, and academic performance.
  • We do not guarantee specific grade or test score outcomes.

9. Technology for Online Sessions

  • You are responsible for your own device, webcam, microphone, and internet connection.
  • We do not record sessions unless we notify you and obtain consent.

10. Acceptable Use of Our Site

  • Do not attempt to interfere with, damage, or gain unauthorized access to our site or systems.
  • You may use site content for personal, non-commercial purposes related to evaluating or purchasing our services.

11. Intellectual Property

  • All site content and curriculum materials are owned by Kern Tutoring or its licensors.
  • You may not copy, republish, or create derivative works without our permission.

12. Testimonials and Media Releases

  • We will obtain written consent before using a student’s name, photo, or video for marketing.

13. Limitation of Liability

  • Services are provided “as is.”
  • Kern Tutoring will not be liable for indirect, incidental, or consequential damages.
  • Our maximum liability is limited to the amount paid in the 3 months preceding the claim.

14. Indemnification

You agree to indemnify and hold Kern Tutoring harmless from claims arising out of misuse of the Services or violation of these Terms.


15. Governing Law

  • These Terms are governed by California law. Disputes will be resolved in Kern County, California.

16. Changes to These Terms

We may update these Terms from time to time. Continued use of our Services constitutes acceptance of the updated Terms.
